TERMS OF SERVICE

    Dessa användarvillkor ("Villkoren") reglerar förhållandet mellan dig som användare ("Användaren" eller "du") och Nabuz Systems AB, org.nr 559306-7159 ("Nabuz", "vi", "oss" eller "vår"), avseende din användning av Nabuz mobilapplikation, webbplats, AI-funktioner, premiumtjänster och andra relaterade tjänster (gemensamt kallade "Tjänsten").

    Genom att registrera ett konto, ladda ner, använda eller på annat sätt få tillgång till Tjänsten godkänner du dessa Villkor samt Nabuz vid var tid gällande Integritetspolicy.

    Om du inte accepterar Villkoren får du inte använda Tjänsten.

    Tjänsten riktar sig till personer som har fyllt 18 år. Genom att registrera ett konto intygar du att du uppfyller detta ålderskrav.

  • 1.1 Availability

    The Service is provided on an "as is" and "as available" basis.

    Nabuz makes no warranties, express or implied, regarding the availability, reliability, accuracy, completeness, security, uninterrupted operation, or fitness of the Service for any particular purpose.

    1.2 Changes to the Service

    Nabuz may, at any time and at its sole discretion, modify, update, suspend, replace, limit, discontinue, or remove any part of the Service.

    This includes, but is not limited to:

    • features and functionality

    • AI-powered features

    • content

    • integrations

    • technical infrastructure

    • user interfaces

    • premium offerings

    Where reasonably practicable, Nabuz will provide notice of material changes affecting paid subscribers.

    1.3 Business Model Changes

    Nabuz reserves the right to modify its business model, introduce or remove premium features, implement usage limits, adjust pricing, or otherwise change how the Service is offered.

    1.4 License

    Subject to these Terms, Nabuz grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

  • You agree to provide accurate and current information when creating and maintaining your account.

    You are responsible for safeguarding your login credentials and for all activity occurring under your account.

    You may not transfer, sell, or share your account with another person.

    Nabuz reserves the right to refuse registration, suspend, or terminate accounts that violate these Terms or applicable law.

  • 3.1 Freemium Model

    The Service may be offered on both a free and paid basis.

    Certain features, content, or functionality may require a paid subscription.

    3.2 Subscriptions

    Premium subscriptions may be offered through app stores, payment processors, enterprise agreements, gym partnerships, employer programs, or other distribution channels selected by Nabuz from time to time.

    Payments are governed by the terms and conditions of the applicable payment provider.

    3.3 Automatic Renewal

    Unless otherwise specified, subscriptions automatically renew until cancelled by the User.

    3.4 Refunds

    Where purchases are processed through third-party platforms, refunds are subject to the policies and procedures of the applicable platform.

    3.5 AI Tokens and Usage Limits

    Nabuz may implement usage limits, token systems, quotas, fair use policies, or similar mechanisms.

    Any credits, tokens, or allowances provided through the Service have no monetary value and may not be redeemed for cash.

    3.6 Partner Accounts

    If Premium access is provided through an employer, gym, educational institution, or other partner organization, these Terms continue to govern your use of the Service.

    If the underlying partner agreement terminates, Nabuz may limit or terminate access provided through that arrangement.

  • 4.1 Third-Party AI Services

    The Service may utilize third-party artificial intelligence and machine learning services.

    Nabuz may add, replace, modify, or discontinue such providers at any time.

    4.2 Data Minimization

    Nabuz seeks to minimize the information shared with external AI providers and limits such sharing to information reasonably necessary to provide the relevant functionality.

    4.3 User Responsibility 

    You are solely responsible for any information you choose to submit through AI-powered features.

    You should not submit confidential information, highly sensitive personal information, trade secrets, or other information that you do not wish to be processed by third-party providers.

    4.4 AI Output

    AI-generated content may be inaccurate, incomplete, misleading, biased, or outdated.

    You are solely responsible for evaluating and relying upon any AI-generated output.

  • You retain ownership of content that you create, upload, submit, or share through the Service.

    By using the Service, you grant Nabuz a worldwide, royalty-free, non-exclusive license to host, store, reproduce, process, modify, transmit, display, and otherwise use such content to:

    • operate the Service

    • improve the Service

    • develop new features

    • create backups

    • provide community and social features

    You represent and warrant that you have all necessary rights to upload and share such content.

  • You agree not to:

    • violate any applicable law or regulation;

    • use the Service for fraudulent purposes;

    • attempt to bypass security measures;

    • reverse engineer, decompile, disassemble, or otherwise interfere with the Service;

    • use automated systems to overload or disrupt the Service;

    • distribute malware, viruses, or harmful code;

    • use the Service in a manner that harms Nabuz, its users, or its partners.

    Nabuz may restrict, suspend, or terminate access in cases of suspected misuse.

  • The Service is intended solely as an informational and motivational tool.

    Nabuz does not provide medical advice, diagnosis, treatment, healthcare services, or professional health guidance.

    Any training programs, workout recommendations, nutrition suggestions, recipes, analyses, or AI-generated content are provided for informational purposes only.

    AI-generated recommendations may be incorrect or unsuitable for your circumstances.

    All exercise, nutrition, and health-related decisions are undertaken at your own risk.

    You should consult a qualified physician or healthcare professional before beginning any exercise, nutrition, or wellness program.

  • To the fullest extent permitted by applicable law, Nabuz shall not be liable for:

    • indirect damages;

    • consequential damages;

    • loss of profits;

    • loss of revenue;

    • loss of business opportunities;

    • loss of data;

    • business interruption;

    • or any other indirect economic loss.

    Nabuz is not responsible for content created by users or generated by third-party systems.

    Nabuz is not responsible for decisions, actions, injuries, losses, or damages resulting from reliance on information provided through the Service.

    If Nabuz is found liable despite the foregoing, Nabuz's total aggregate liability shall not exceed the greater of:

    (a) the amount paid by the User to Nabuz during the twelve (12) months preceding the claim; or

    (b) SEK 1,000.

    Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

  • All intellectual property rights relating to the Service, including software, databases, designs, trademarks, logos, graphics, text, functionality, and other materials, are owned by Nabuz or its licensors.

    Nothing in these Terms transfers any ownership rights to the User.

    You may not reproduce, distribute, sell, sublicense, modify, or otherwise exploit the Service without Nabuz's prior written consent.

  • Nabuz may from time to time offer experimental, beta, preview, or early-access features.

    Such features may contain errors, may change without notice, and may be discontinued at any time.

    Beta features are provided without additional warranties.

  • You may terminate your account at any time using the functionality provided within the Service.

    Nabuz may suspend, restrict, or terminate your account immediately if:

    • you violate these Terms;

    • you misuse the Service;

    • you violate applicable law; or

    • your use presents risk or harm to Nabuz, other users, or partners.

  • Nabuz may update these Terms from time to time.

    Where material changes are made, users will be notified through the Service, by email, or through other reasonable means.

    Continued use of the Service after such changes become effective constitutes acceptance of the updated Terms.

  • Nabuz shall not be liable for delays or failures resulting from circumstances beyond its reasonable control.

    Such circumstances may include, without limitation:

    • natural disasters;

    • war;

    • terrorism;

    • pandemics;

    • government actions;

    • labor disputes;

    • internet outages;

    • cyberattacks;

    • power failures;

    • supplier failures; or

    • similar events.

  • These Terms shall be governed by and construed in accordance with the laws of Sweden.

    If you are a consumer residing within the European Union, nothing in these Terms limits any mandatory consumer protection rights available under the laws of your country of residence.

    The parties shall first seek to resolve disputes through good-faith discussions.

    Consumers may submit complaints to the Swedish National Board for Consumer Disputes (ARN) or any equivalent consumer dispute body available under applicable law.

    Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Sweden, with the Stockholm District Court serving as the court of first instance unless mandatory law requires otherwise.
